These Terms and Conditions (“TAC”) constitute a legally binding agreement made by and between Vivamake, (“Vivamake”) which operates www.vivamake.com (“Website”) and you, whether personally or on behalf of an entity (“You”). These TAC govern your use of the Website and products offered on the Website so please read them carefully.

SHIPPING
Processing time and estimated shipping

We do not ship on weekends or holidays. If your ship date lands on either of these options, it will be mailed on the next business day.  Thank you for your understanding. Many times it is quicker than this posted time, but we feel better indicating a longer time so there is no discrepancy when it comes to deadlines.

We’ll do our best to meet these shipping estimates, but cannot guarantee them. Actual delivery time will depend on the shipping method you choose. Some postal addresses in some countries and some remote areas may not be covered by our normal delivery services   and so we may have to contact you to advise you of extra postal charges.

CUSTOMS AND IMPORT TAXES

International customers are responsible for all fees associated with shipping to their respective countries. Orders that are shipped to countries outside of the Lithuania may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates. All international orders will have full value declared on customs forms – no exceptions.
We will not mark international shipments as “gift” or indicate lower pricing to avoid custom fees.  Marking it as a such is mail fraud. We can not risk our business to honor such requests.

PACKAGING

In an effort to be environmentally responsible, we use as few packaging and shipping materials as possible. We most often use paper envelopes/packages, carton boxes for larger orders. We do not include a paper receipt in our orders.  If you would like one, please request one.  We feel it is a misuse of paper, given a receipt has already been issued electronically  when the purchase is made, and when the item has shipped.

PAYMENT

Payments can be made by credit cards (Visa, MasterCard) or PayPal.

PRICING

All prices are in EUR andinclude VAT (where applicable) at the current rates.

CHANGES TO THE WEBSITE OR SERVICE

Website may, in its sole discretion, change, modify, suspend, make improvements to or discontinue any aspect of Website, temporarily or permanently, at any time without notice to you, and Website will not be liable for doing so.

Users should feel free to use this site as a shopping resource, but any other use of the site, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on this site is strictly prohibited. In addition, the software used on this site is the property of Vivamake or its software suppliers and is protected under LT and international copyright laws.

OWNERSHIP AND USE

Vivamake will retain ownership of its intellectual property rights and you may not obtain any rights therein by virtue of these TAC or otherwise, except as set forth in this TAC. You will have no right to use, copy, display, perform, create derivative works from, distribute, have distributed, transmit or sublicense from materials or content available on Website in the normal course of your use of the Website. You may not use any third-party intellectual property without express written permission of the applicable party, except as permitted by law.

GOVERNING LAW

The law which shall resolve all disputes between the parties shall be the laws of the Lithuania Republic.

CANCELATIONS

For Non-Faulty Goods

If for some reason you decide to cancel your order, we will honor that request. If you refuse a shipment we can refund only once the package is safely back in our hands. Please note that refund will exclude shipping costs and only the amount of good/goods will be refunded. If you have had a change of heart you must return the item to VivaMake.com unused and in its original condition within 14 days for a refund. All you pay for is the postage cost of returning the goods. Each returned product must include all parts, accessories, instructions and packaging, etc.
If it is a personalized item with specific (names/dates/custom message), no refund will be given if the package is refused or returned.  If you refuse an item, return it to us and decide you want it returned, new shipping costs will be at the buyer’s expense. The product will remain your responsibility until it has been signed for at the returns address. We do not accept responsibility for return products lost or damaged in the post.

Exceptions

We regret that we cannot accept returns on the following non-faulty products:

  • The product(s) has/have been personalised, made to order or customised in any way.
  • The packaging or any of the individual product components, has been unsealed or damaged.
  • The non-faulty product does not arrive at Vivamake in a resalable condition. In this case we will not be able to offer you a refund. We will call you to arrange to send the product back to you and to take payment for the subsequent delivery costs.
For Faulty Goods

If the product you have ordered is faulty you have 30 days in which to return it. Parcels or items damaged in transit must be verbally reported to VivaMake.com the next working day following delivery, and also by email (info@vivamake.com) within 3 days.
When returning faulty items we may still ask you to return goods yourself. On receipt Vivamake will reimburse the costs incurred*. Vivamake shall pay you a reasonable** postage amount for the return of the product. We normally ask that goods are sent back via post.

* Please obtain a proof of postage costs so we can reimburse you the full amount.
** Please note that by reasonable we mean any delivery service equivalent to the cost of post.

If the deadline for reporting parcels damaged during transit is not met we regret that we will not be able to issue a refund or replacement goods.
We will not confirm that we have received your return. After receipt of your goods we aim to issue refunds within 14 working days. The cost of your products will be refunded to the credit/debit card used to make the purchase. Please note refunds take 5 working days to clear from the point of processing.
